reopened as a specialty hospital in March almost four years after
an electrical fire closed its doors. LHW, on Gordon Street, is back
in business providing: D<xhtml:span lang="EN-GB" xml:lang="EN-GB">ialysis, Complex Continuing Care, Palliative Care,
Respiratory Rehabilitation and Ambulatory Rehabilitation for
patients that experienced a stroke, brain injury, paralysis, or
joint replacements. The Positive Care Clinic, Diabetes Program and
the Durham Region Diabetes Network are also key areas of care in
this facility for those living throughout
Durham.</xhtml:span></xhtml:span></xhtml:span></xhtml:div>
<xhtml:span style="font-family: Arial Narrow; font-size: small;"><xhtml:span lang="EN" xml:lang="EN"><xhtml:span style="font-family: arial,helvetica,sans-serif;">These services that the
Foundation raises money for are unique! They directly impact the
overall health care delivered throughout Durham and are housed in a
local facility embraced by the Whitby community. "Our hospital is
special; there is no doubt about it. The model of care that is
delivered is based on the belief that a Doctor cannot do it alone.
While here, a patient’s care is part of their journey … not their
destination," says Dr. Park, Medical Director of Post Acute
Specialty Services (PASS). The Foundation partners with Dr. Park
and the Capital Planning team to understand the intricate details
of each patient`s care and then fundraises within the Durham region
to meet those needs and provide program
sustainability.</xhtml:span></xhtml:span></xhtml:span></xhtml:div>

issuance and conviction of a traffic violation does not in and of
itself disentitle a Plaintiff from pursuing a civil action due to
injuries sustained in a car accident.  A Plaintiff is not precluded
from leading or giving evidence about the Defendant's driving to
decide if the accident was the sole responsibility of one or both
parties.</xhtml:p>

      <xhtml:div xmlns:xhtml="http://www.w3.org/1999/xhtml"><xhtml:p>Arbitrator Makepeace agrees with our position on this Appeal
that where a claimant resides in a chronic care or long-term
facility, s.16 of the SABS-1996 requires the insurer to pay
attendant care benefits for services provided by an aide or
attendant as well as any co-payment fees charged by the facility.
Plaintiffs were found to be entitled to attendant care while in
hospital.</xhtml:p>

      <xhtml:div xmlns:xhtml="http://www.w3.org/1999/xhtml"><xhtml:p>The Ontario Court of Appeal agrees with our position that the
finding of a CAT DAC is binding on the insured and the insurer and
subject to the determination of a dispute in accordance with
sections 279 to 283 of the Insurance Act relating to whether the
impairment is a catastrophic impairment. DACs were later eliminated
from our legislation.</xhtml:p>
